The Platform provides AML/CTF awareness and compliance training, together with related tools and records. This material is general in nature and is provided for educational purposes only. It does not constitute legal, financial or other professional advice, and must not be relied on as a substitute for advice tailored to your circumstances.

Nothing on the Platform relieves you or your organisation of your own obligations as a reporting entity under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), the associated Rules, or any requirement of AUSTRAC or other regulator. You remain solely responsible for your own AML/CTF program, risk assessment, policies and compliance. Completion of any course, module or assessment on the Platform records participation in training only; it does not certify, warrant or guarantee that you or your organisation are compliant with any law or regulatory requirement.

Where the Platform offers CPD tracking or demonstration features, those features are a learner-selected and learner-owned tool intended to help you record and demonstrate your own CPD activity. They assist and demonstrate only — they do not assign, enforce, certify or guarantee that you have satisfied the CPD requirements of any professional body, regulator, scheme or employer.

You are responsible for selecting the CPD scheme relevant to you, for confirming your own CPD obligations, and for the accuracy and completeness of the activity you record. Levit8 does not verify CPD entries and gives no assurance that any record will be accepted by a third party.

Access to password-protected or secured areas of the Platform is restricted to authorised users. You agree to provide accurate and current information when registering or maintaining an account.

You are responsible for keeping any username and password confidential — whether chosen by you or assigned to you by your organisation’s administrator — and for all activity that occurs under your credentials. You must not share or misuse your credentials, misrepresent your identity or your affiliation with any organisation, impersonate any person or entity, or misstate the origin of any material you access through the Platform. Where you administer users within your organisation’s tenant, you are responsible for managing access appropriately and for the conduct of those users.

Please notify us promptly if you become aware of any unauthorised use of an account or any other breach of security.

The Platform may link to, or integrate with, websites and services operated by third parties (for example, single sign-on, payment, email or video-conferencing providers). Those sites and services are not under our control, and we are not responsible for their content, accuracy, availability or practices. A link or integration does not imply any endorsement.

If you access any third party site or service, you do so entirely at your own risk and subject to that third party’s terms. To the extent permitted by law, we disclaim all warranties, express or implied, in relation to any third party site or service, including as to accuracy, ownership, validity or legality.

To the extent permitted by law, you agree to indemnify and hold harmless Levit8, and its officers, employees, agents and affiliates, from and against any claims, liabilities, damages, losses or expenses arising out of or in connection with your access to or use of the website or Platform, or your breach of these terms.

To the maximum extent permitted by law, and subject to the paragraph below, in no event will Levit8 or its suppliers or affiliates be liable for any indirect, special, incidental or consequential loss or damage — including loss of profits or revenue, loss of or damage to data, or the cost of replacement goods or services — arising out of or in connection with your use of, or inability to use, the website or Platform, whether based in contract, tort (including negligence), warranty or any other legal theory, and even if we have been advised of the possibility of such loss or damage.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.

We take care in preparing content for the Platform, but we assume no responsibility for its accuracy, currency or completeness. You should not assume that content is continuously updated or that it reflects the current state of the law or regulatory guidance. We are not responsible for supplying content that has expired or been removed.
